Edo: Victory for APC as Court voids removal of council boss

A victory was recorded for the All Progressives Congress (APC) in Edo on Friday as a state High Court presided over by Hon Justice D.I. Okungbowa voided the removal of chairman of Esan West Local Government, Hon Patrick Aguinede.

The court ruled that the decision of Governor Godwin Obaseki to remove the council boss was null and void.

The court declared the purported removal of Aguinede by Edo Governor Godwin Obaseki as null and void.

The suit was marked B/11/2020

In the ruling, the court directed him to resume office as chairman immediately.

Justice Okungbowa approved all requests contained in the originating summons filed on behalf of Aguinede by the Law firm of West-Idahosa & Co.

According to the court,  Obaseki and government did not comply with the Provisions of Sections 20 and 21 of Edo State Local Government Law, 2000 (as amended) in failing to consult with the Edo State House of Assembly before suspending Hon. Patrick Aguinede.

The court added since the suspension was illegal in law, every other action sorrounding it was also illegal.
